The lawsuit was filed the day after President Trump signed the executive order that aimed to end birthright citizenship, in violation of the 14th Amendment and the Immigration and Nationality Act. They are asking the federal judge to prevent the president’s order from taking effect.

The hearing in Boston concerned two separate but similar lawsuits, one brought by the 18 states, the District of Columbia and the City of San Francisco, and the other on behalf of an expectant mother by Lawyers for Civil Rights, an advocacy group based in Boston.

The Justice Department argued that the 14th amendment has been misinterpreted by the Supreme Court and doesn’t grant birthright citizenship to children of people who are unlawfully present.
